NOC election: Court adjourns suit against Ndanusa

An Abuja High Court has asked the former Chairman of the Gombe State Football Association, Alhaji Gara Shuaibu Gombe to file his motion seeking to serve the Nigerian Olympic Committee (NOC) with the court process where-in he is challenging the candidacy of the Minister of Sports, Engr. Sani Ndanusa in the on coming election for the NOC President on Monday January 4, 2010.
Alhaji Gara needed an order of the court permitting him to serve the NOC with copies of the court process since the association’s headquarters falls outside the jurisdiction of Abuja high court.
The vacation Judge, Justice Othman A. Musa advised Gara through his counsel, Barrister Ahmed Zumaru to bring a motion before the court to obtain a court order to serve the NOC with copies of the court process in order for them to have knowledge of the suit and appear accordingly.
The court said that there was no way the matter can be heard unless the NOC, being the 1st respondent was properly served as a party in the matter.
Meanwhile, the Counsel representing the Sports Minister had dismissed any speculation that the pending suit could occasion any damage or obstruction to his aspiration for the post of NOC president.
The former chairman of Gombe State Football Association instituted is praying the court for an order of interim injunction restraining the NOC from giving recognition to Ndanusa as candidate in the said election.
In the suit filed by way of originating summons, Gara who invoked the original jurisdiction of the court by claiming locus standi on grounds that he is a stakeholder in Nigeria sports is contending that Ndanusa who is the second defendant in the suit does not have the mandatory four years to be eligible to contest the presidency of NOC.
The court adjourned till Monday 4, 2010 for the plaintiff to bring the motion seeking to properly serve the NOC, the 1st respondent.
